
1. What is an environmental impact assessment?
Environmental impact assessment, or EIA or EIA for short, is the analysis and forecast of the impacts of an investment project on the environment in order to take measures to protect the environment when implementing that project. 23, Article 3 explaining terms, Chapter I General provisions, Law on environmental protection No. 55/2014/QH13)
According to the provisions of the Law on Environmental Protection 2014, the environmental impact assessment must be carried out during the project preparation phase (Clause 2, Article 19).
2. Objects must carry out EIA environmental impact assessment
The subjects that must carry out the environmental impact assessment are specified in Appendix II of Decree No. 18/2015/ND-CP:
Group of projects on construction, production of building materials
Group of projects on transportation
Group of projects on electronics, energy, radiation, oil and gas
Group of projects related to irrigation, forest exploitation, cultivation
Group of projects on mineral exploration, exploitation and processing
Group of projects on waste treatment and recycling
Group of projects on mechanics, metallurgy
Group of production and processing projects (food, agricultural products, wood, ceramics, glass, paper, fertilizer, etc.)
3. Environmental impact assessment report appraisal agency
Normally, for projects to build factories in industrial zones, the appraisal agency is the Provincial People's Committee. However, depending on the nature of the project, the approving agency may be the Ministry of Natural Resources and Environment
